Anaheim Hills Child Custody

Anaheim Hills Child Custody Lawyer

Anaheim Hills child custody has two parts under California law: physical custody and legal custody. Joint custody allows the parents to have joint physical custody and joint legal custody. However, the court can award joint legal custody, and not award joint physical custody. Under physical custody, one parent may be granted sole physical custody where the child would reside with and be supervised by one parent. Under joint physical custody orders, the parents share physical custody, and the law ensures that the child have frequent and continuing contact with both parents.

Sole legal custody allows one parent the right and responsibility to make decisions about the health, education, and welfare of the child. Joint legal custody allows both parents to share these rights and responsibilities. California law does not establish a preference for sole or joint custody in contested proceedings.

There are considerations the law establishes in making Anaheim Hills child custody awards. Public policy of California is to ensure the minor children frequent and continuing contact with both parents. Also, custody orders must be made according to the child's best interest. Domestic violence and a history of abuse will be considered by the court in determining the child's best interest. Move-away/relocation cases arise when one parent seeks to move to another jurisdiction. The court must evaluate the child's need for stability and continuity. Move-away/relocation cases are generally hotly contested.

Spousal Support/Alimony Lawyer

California spousal support can be temporary and long-term. Temporary support can be awarded while a dissolution or legal separation is pending. The court may award an amount depending on he party's need and he payer's ability to pay. Judges typically use the support software when ordering temporary Anaheim Hills spousal support.

Long-term Anaheim Hills spousal support may be ordered by the court in any amount, and for any period of time that the court deems just and reasonable. In making a determination for support, the court must base its decision on the marital standard of living. The court must also consider the extent to which each party's earning capacity will maintain the standard of living established during the marriage. The complete list of factors the court must consider are found in California Family Code section 4320.

Limited Scope Representation

California attorneys are allowed to provide Anaheim Hills limited scope representation to clients involved in family law and civil cases since it was approved by the Judicial Council. Many parties to family law and civil litigation actions would like the help of an attorney for parts of their cases, even if they cannot afford full representation. Attorneys may appear at court hearings even if the attorney did not prepare the legal paperwork. In contrast, attorneys can prepare legal paperwork, but do not have to appear in court if the cause of action actually gets to the point of having court dates. Most people find that having an advocate at the court hearing helps alleviate additional stress that is naturally created with litigation.

About Anaheim Hills, CA

The community of Anaheim elected to develop Anaheim Hills in 1970. As a result of the homes in this new community being sold in only two years, the project was a great success. However, the history of Anaheim Hills goes back almost 200 years.

In 1810, a man named Jose Antonio Yorba and his nephew named Juan Pablo Peralta were granted a portion of the land in Anaheim Hills. The land Mr. Yorba owned was known as Rancho Santiago de Santa Ana and contained 210,000 acres.

The Yorba family used a considerable amount of the land in the Santa Ana Canyon region to plant large vineyards and orchards and to raise livestock. In 1884, by patent decree of a US District Court, the Peralta and Yorba grants were confirmed. In 1868, two men named A. B. Chapman and Andrew Glassell purchased subdivided portions of the original Yorba lands. The Jotham Bixby family had also purchased an interest in the southernmost part of the Santa Ana Canyon by 1885.

In the Santa Ana Canyon region, the Bixby lands were granted to Mr. and Mrs. Louis Nohl in 1943. The Nohl Ranch consisted of some 5,800 acres and was used to raise about 23 acres of oranges, to raise avocados, and as grazing and pasture land for some 1,100 head of cattle. The early Orange County farm environment that Mr. and Mrs. Nohl raised their family in was very serene. The Santa Ana Valley Irrigation Company canal was used for swimming and made for great evening events in the summertime. As compared to the immediate cash value for the locations of future homes, the value of pasture and grazing land declined during the 1960's as a result of the increase of the development in northern Orange County.

In order to develop land for the cities of Anaheim and Orange the Nohl family started selling small parcels of land during the late 1960's. In 1970, Anaheim helped with the development of a 920 gallon filtration plant and reservoir on the Nohl Ranch Hills because additional water storage was needed. With the intention of creating a new planned community to be known as Anaheim Hills, Santa Anita Consolidated Inc. was deeded some 4,200 acres of the Nohl Ranch in 1970. Soon, the community of Anaheim bought some 300 additional acres of the Nohl Ranch for parks and a tournament class golf course.

In 1971, a joint venture between Texaco Ventures Inc. and Anaheim Hills was deeded the land for the purpose of residential development. The general plan for the development of Anaheim Hills required the construction of some of the best homes in Orange County. In 1972, the first neighborhood was established, which is known as Westridge. By early 1975, all 325 homes were sold. As new neighborhood that was built by many different high quality developers, the development of residential neighborhoods continues to expand. The Anaheim Hill Planned Community Association took responsibility for the landscape maintenance and integrity of the architecture. The population of Anaheim Hill was over 15,000 people by the early 1980's.

During the middle 1980's, Anaheim annexed the Wallace, Oak Hills, and Bauer ranches, which added another 1,300 acres to the community. Anaheim Hills offers the residents many different recreational opportunities such as places of worship, commercial shopping centers, a nature center, several different parks, hiking and riding trails, a saddle club, and a tennis club. The Orange County Unified School District provides the public educational facilities, which include high school, middle school, and elementary school campuses.

During the development of residential neighborhoods, the developers of Anaheim Hills have been concentrating on the preservation of the natural environment of the ranch as much as possible. During construction, long standing groves of indigenous trees such as eucalypts, oak, and sycamore have been bypassed. In order to ensure that Anaheim Hills maintains its natural beauty, almost 1,000 acres of land have already been dedicated to public agencies.

These days, following 200 years of hard work, this distinguished community is continuing to expand. The population of Anaheim Hills was 55,036 people according to the 2010 census. Within minutes of residential neighborhoods, there are modern conveniences including entertainment, fine dining, and shopping. Anaheim Hills enjoys one of the lowest crime rates in Orange County. This exclusive community environment provides the residents with a quiet and safe place to call home.
